Theory is not the same as scientific theory.

Evolution is an observed fact. There are multiple theories of evolution, such as Darwin's theory of natural selection, that go about explaining said fact.

A theory is a fact in science terms, not in day to day terms. Gravity is a theory, but its also a fact.
