11 isn't above 12. I'm sorry but I don't make the rules, if it were me I would make sure all underage players are banned since that hole violation of government rule and violation of terms of service which is also enforced by the govt. I would consider your brother lucky.

Nothing to do with the rating. The COPPA act introduced a raft of recordkeeping requirements and hoops to jump through when dealing with children under 13, and the FTC has already levied multi-million dollar fines on companies that haven't complied or have complied wrong. The best way to avoid the whole mess is to not offer your online service (which is what Destiny is) to people under 13.

I'm replying to him because the ESRB has no legal or governmental standing, it's a rating based on appropriate content for the consumer. It's not illegal for an 11 year old to play a rated T game.

Again, your advice would be better aimed at Bungie's legal department, who seem to have put wording prohibiting children under 13 in their ToS, for no apparent reason. Clearly, they could do with the benefit of your legal advice.
