Freedom of religion means you can practice what you want, but it doesn't mean you can ignore FEDERAL LAW. Topeka was an example of people ignoring FEDERAL LAW and losing.

  • Difference between this and Topeka is that they didn't have a religious basis which is protected by the constitution. A Federal Law cannot overrule a Constitutional right. Correct me if I'm wrong. Now she has a right to freedom of religion. Her religion prevents her from giving those licenses to gay couples. It can be concluded that it is [b]unlawful[/b] for her to refuse those licenses [i]but it is [b]unconstitutional[/b] to punish her or force her to do it.[/i]

  • Federal Law can modify Constitutional Amendments. Like how we have Freedom of Speech, yet can't yell "Fire" in a crowded theatre. Again, you can practice what you want, as long as it doesn't infringe on Federal Law or the rights of others.

That part is covered by the "Separation of Church and State" clause. [i]In 1878, the Supreme Court was first called to interpret the extent of the Free Exercise Clause in Reynolds v. United States, as related to the prosecution of polygamy under federal law. The Supreme Court upheld Reynolds' conviction for bigamy, deciding that to do otherwise would provide constitutional protection for a gamut of religious beliefs, including those as extreme as human sacrifice.[/i] So, as you can see, Federal Law [b]can[/b] restrict religious beliefs.
