This isn't tongue-in-cheek, this isn't sarcastic, and this isn't even meant as a "haha you're stuck in the past" barb at the PS3 and 360 players.
I'm just legit amazed that you guys haven't gotten together and said, "This is not what we were promised when we invested $60 - $100+ in buying this game and the updates that it turned out. We're not going to settle for this treatment and this kind of exclusionary behavior, just because we're less financially-capable of buying a next-gen console."
Don't get me wrong, I 100% understand the hardware limitations that come with the older consoles, and I 100% understand that Destiny has just about reached that limitation on both machines. But it goes way beyond that, with all of the extra-steps they've been taking to proverbially cut the balls off of the last-gen players.
They could've honestly just left it at, "You won't be getting the next big expansion, because it just can't support what we're trying to do with it." But Bungie has seen fit to not only cross the line, but barrel across it and then piss all over it once they're on the other side.

> "You won't be playing Trials of Osiris anymore; you won't be getting Trials-Gear anymore."
> "You won't be playing Iron Banner anymore; you won't be getting Iron Banner-Gear anymore."
> "You won't be enjoying the live-events like Festival of the Lost anymore."
> "You won't be getting anymore updates to gear, and so you won't be getting higher light-levels anymore."
And that's just a few things to list off. Bungie has basically told you guys, "The game's over until you decide to upgrade. Now go piss up a rope." All of this is why I'm amazed that these two communities haven't gotten together and said, "No. -blam!- that shit. Class-Action Lawsuit."
Don't get me wrong; I'm on my Next-Gen console, personally. I'm 100% ready for the update and waiting eagerly for September. But as someone who's spent most of my life being stuck in "Last-Gen" situations, as far back as the PS2 era (I didn't get a PS2 of my own until almost 2005), I feel bad for you guys.
To me, this just seems like you're getting a bad cut, no matter how you slice it.

Because time is money. To keep those activities in last gen, they would also need consistent maintenance to keep it all working properly. Consistent maintenance requires upkeep of the old code for last gen and the new code for current gen. They then need to make sure everyone knows how to use both the old and new code for consistent upkeep. This means new hires have to waste time learning the old code [i]and[/i] the new code. By removing weekly/monthly activities, Bungie greatly reduces the chances of major issues cropping up on last gen. This means they can spend less time working with an entirely separate code for last gen fixes. Last gen also consists of [i]less than 10%[/i] of the playerbase. It's just a moneysink worrying about last gen more than they have to. Bungie is, after all, a business. I don't expect film companies to keep producing VHS. I don't expect record companies to keep producing 8-tracks. And I don't expect Bungie to have to keep consistently pushing out fixes for a 10 year old console.

Tough shit. Bungie can do whatever they want. We accept that when we log on and scroll through the fine print. Realistically the 1st instalment of the game should follow through in its entirety for the last gen guys. Destiny 2 can leave them behind. I feel that cutting them off right near the end of Destiny 1 is bad business. If I was one of those players getting the shaft I wouldn't buy a product from these guys again. Just my opinion.

You would only be able to claim actual losses, so $60-100. Then split it up with all class action participants. Then the lawyers take their cut. Then the lawyers charge for services. So you'd actually owe approximately $57,248.82. Give or take.

Um... You realize how much any lawyer would laugh in your face if you asked them to do that? On top of that the judge would probably order the plaintiff to cover all expenses for both parties when he threw the case out for not having any grounds.

How do you expect bungie to run two different versions of live servers? That would not be cost effective seeing as how only 10% of the player based is on last Gen. Hence why they won't have live events anymore.

I'm a PS3-user, and have been very vocal in stating my general displeasure at this change in things. However, no class action suit is appropriate. We're still getting the game we paid for. All missions will function, prison of elders will work, the Crucible will be available. Bungie will continue to take care of us as much as they can. We will lose the Iron banner, we will lose Trials, and we will effectively lose Xur. But that just means we won't get the freebies that Bungie gave us because they're so awesome and try to be nice to us. They do this in hopes that we will stay, buy more stuff, and tell our friends how awesome Destiny is (they want to make us happy because making us happy makes them more money). Bungie probably has a legal department that has forgotten more about matters of this nature than any of us will evr know. They wouldn't freeze us out unless it was entirely within the parameters of the law for them to do so.

What is the basis of your lawsuit? On what grounds are you suing? See you can't just file a lawsuit because somebody pissed you off. Bungie never promised you anything in terms of updates, light increases or new weapons. So sack up and stop whining. Upgrade or be left behind, the choice is yours, just don't try to make others feel bad for you.
