Some of these features of the xbox one appear to be quite illegal if they were to occur in the EU/UK. With the features of an always on kinect, collecting data on us possibility and the issue of not actually having rights to games anymore.

These are just the current issues that can be seen with the xbone. If these DRM follows through what will happen to the selling in europe? I mean cutting out a large chunk of your target market doesn't bode well in business.
TLDR: The drm features break eu law on used game sales and on privacy.

"Pause" implies it is still partially active otherwise they would of said it can be "turned off". Over here webcams must have the option to be fully turned off if we want to, pausing does not count.

I will inevitably upgrade at some point from the 360, when I do however, I intend to cover the sensor or put a picture in front of it. I'll also unplug it when I'm done playing

While kinect has to be plugged it, it doesn't have to be on.

Kinect Camera < Any item thicker than tracing paper. Microphone....I'd have to weigh this one up but if I KNEW it was always on and if I had alternate comms then I'd just open the case and crush it with a pair of pliers.

Wow lol, try harder next time kid. The Kinect sensor can be turned off at any time, it is not mandatory. The Xbox One simply comes packaged with it so you do not have to go out and buy one yourself. If you do not want it, then you are not forced to use it. And I do not understand the problem with used games that everyone has. If you want a game, go buy it, instead of trading your games with all of your friends and stealing money from the game developers.

It's already been confirmed that you can turn the new Kinect COMPLETELY off. Microsoft spoke out on that one. Not sure about the DRM sales though. Could cause quite the mess...
