why aren't infantry who have killed someone charged with murder?

The obvious answer is that no taking of human life is right, and all killing is wrong. Though, I would say that if an infantryman is guilty of murder, the general who planned the operation and the politician that made it a necessity are more guilty and deserve more of a punishment.

Because murder is the unlawful killing of a person. War is legal, making the killing in it legal and thus not murder

Murder is a concept, not a reality.

Murder is legally defined as "unlawful culpable homicide". Soldiers killing each other, while homicide, is not unlawful.
