they have called the new halo game "halo 5: Guardians", ripped off from our Destiny guardians

Well.. in halo "Guardians" refers to the giant a** robots of destruction and stuff. Destiny "Guardians" refers to 3 different either sucky or op warriors that sometimes can be badass and sometimes kill a badass creature like Crota or oryx

Halo has had guardians before destiny started development. If anything, destiny is copying halo.

And yet halo is a much better game all around rather have a good game copy some good stuff off a bad game and make it good

You do know that the concept of Guardians is drastically different in both games, right? Bungie, nor 343i, trademarked the label "Guardians".
