The odds of being banned are slim on this one, unless I am misunderstanding the network exploit. I believe that the spirit of the TOS for each platform is referring to people using third-party software or hardware to find & exploit a weakness in the game's code. An example of such an exploit would be using software to create latency during a PvP match so that the game believes that your character is one step ahead (or behind) Melee/Ranged attacks...for that, the BanHammer may not strike right away, but it will find you. :-)
With Crota (to my knowledge), it's not playing as intended, and is probably causing more than one Bungie Developer to curse, swear & kick a copier, however, isn't a BanHammer worthy offense...if it was, I think Bungie/Activision would have stated something by now, or we would have at least seen a heck of a lot more "WTF?! Why was I banned?!?" threads.
For now, the rebels get to be rebels, the sanctimonious can cry foul while those that dial Emergency when they see someone speeding can post "They're going to get you!" posts. ;-)
It is the holidays, happy thoughts; is it irritating? Yes. Will it be fixed before the Crota Hard Raid comes out? Probably. Will this particular exploit destroy Destiny's game-balance as we know it? Not likely...Devs intentionally held back the "ultra-leet" primary weapons, giving the community the chance to find, and then brag about, said exploit(s) so that it can be addressed. ;-)

My issue with this whole banning thing is that if they made a game that worked in the first place I wouldn't even have attempted to look up how to cheese let alone try it. My group and I tried crota countless times and the big issue we had was that his shield either would nearly all disappear and then magically refill or just wouldn't go down at all. Or we'd get it down once and then the sword bearers hits would take no damage off. Maybe if the game played right in the first place a lot of the people who do cheese wouldn't need to. This is once again going to be bungie fixing a glitch in the game rather than actually fixing a problem with the game.
