Terms of Use Questions for Destiny API

Is there a person/email I can contact regarding terms of use questions? I have a created a fully functioning site using the destiny API that I want to deploy to production soon. However, I have a few Terms of Use questions I would like to get answered first. I am not using any Bungie assets/static content on the site - just consuming the destiny API services. My questions are as followed: Is it okay to place one banner advertisement on the site? In the terms of use it mentions that commercial use is prohibited. However, many of the big destiny fan sites have advertisement such as: DestinyLFG.com DestinyLFG.net DestinyTracker.com planetdestiny.com destinyteamfinder.com. If there is a Bungie employee I need to demo the site to I would be happy to do so. Is it okay to have a url with Destiny in it? Again, the Terms of Use seems to lean away from this. However, if you look at the sample of above destiny fan sites they all have Destiny in the domain name. I have a name in mind and it has the word Destiny in it. What is the exact verbiage I need to put in the footer of my site if I am consuming Bungie services? Again - I am not using any of the Bungie assets/static content. Any help would be greatly appreciated!

  • Ahh, so as a dev I'm utterly unqualified to answer legal questions about terms of use... hang tight, I'm trying to get a hold of our legal folks to see if I can get an answer for you all.

    • Well, i can tell you that all those websites you mentioned they don't appear to be breaking any ToS, because in the terms of services it says that you can't get any money from it, IF, all the functionality you provide is based on bungie's APIs, and they all have more than that the APIs is only a small part of what they do and some of them like LFG they don't even had APIs until they added the option to search for a character. Also, it doesn't seem like Bungie is enforcing in any way their own ToS, because i've seen like 2-3 android apps that do break them, and they have done nothing about it, so, i'll assume that if you break them they'll do nothing about it, unless you break other terms apart from the making money out of it. At least in my app I've no Ads or anything related to avoid breaking them, but, that's a personal preference i don't need money out of the app i just enjoyed doing it, and i take it as a very time consuming and expensive pay-less hobby (Thou my wife doesn't like that :P).

      • Also as a follow-up question, what is the reasoning behind prohibiting advertisement? Many big games are now allowing developers to make revenue while using their services such as League of Legends. Revenue = more developers making websites to support the community and ultimately will provide the best possible services for developer's game.
