I honestly don't know how this has never been a bigger news story.
Bungie has created an environment through a distributed P2P network and a competitive gaming reward system that encourages players to initiate DoS attacks (a Federal Crime in the US) in order to win at their game. Further, the demand to win at the game is high enough that services have sprung up where-by one player can pay another to perpetrate these crimes on their behalf.
Meanwhile Bungie/Activision takes no responsibility in policing the P2P infrastructure they maintain, and do not even perform basic common sense monitoring, banning, and reporting of obvious perpetrators of these crimes to authorities. I'm no lawyer, but I can't see how Bungie/Activision and perhaps by extension Microsoft/Sony is not at least partly complicit in DoS crimes being committed via their P2P platform.
