I say no because they don't have the rights to halo anymore, as far as I understand anyway, and any reference opens themselves up to a lawsuit and that would be...bad tko say the least

That won't matter. As long as they aren't putting in someone named Spartan-117 they are fine. You are allowed to reference trademarked and copyrighted material. Also this game is coming out on XB1 and PS4. That would just be extra advertisement for Microsoft since the Halo games are only on Microsoft machines.

True enough. I've seen enough patent trolls that I would always err on the side of caution but I'm not bungie or activision ao they may do just that

They could do that but it wouldn't be a huge thing because I'm fairly certain that is trade marked in reference to a person
